摘 要: 基于在调整特定地方社会关系上所体现出的功能优势,民间规范构成了一种可资地方立法借鉴、吸收的法治'本土资源'。然而,受制于理论和制度的双重成因,地方立法吸收民间规范仍缺乏程序化路径支持。为突破地方立法吸收民间规范的程序困境,有必要展开地方立法吸收民间规范的程序再造。地方立法吸收民间规范程序再造的正当性在于其因应正式规则与非正式规则的整合规律、符合地方治理法治化之于'本土资源'的利用需求且契合地方立法程序建设的价值导向。同时,这种程序再造应立足于制度层面并从地方立法的立项程序、起草程序、正式立法程序与立法后评估程序系统展开。 Based on the functional advantages reflected in adjusting certain social relations,folk norms constitute the'local resources'that the local legislation is able to draw upon.However,subject to both theoretical and institutional reasons,local legislation absorbing folk norms lacks of the support of proper procedure.To tackle the problem of the lack of a proper procedure in local legislation absorbing folk norms,there is a necessity for the procedure regeneration of local legislation absorbing folk norms.The legitimacy of the procedure regeneration of local legislation absorbing folk norms lies in three parts:the integration of official and unofficial rules,meeting the need of harnessing the local resources required by the rule of law in local governance as well as conform to the value orientation of the development of local legislation procedure.The procedure regeneration should base on the institution while develop through the process of project initialization,draft,official legislation and post-legislation evaluation in local legislation.
