摘　　要： 在近年的新闻侵权案审判中,一些地方的法院采用了'谁报道、谁举证'的'新闻审判原则',强化了被告的举证责任,减轻甚至免除了原告的举证责任.这实际上违背了民事诉讼法规定的举证基本原则,违反了新闻规律,不利于保障新闻工作者的舆论监督权,因此有必要在新闻侵权诉讼中重申贯彻'谁主张、谁举证'的原则. While handling press tort action in recent years,courts at various levels have adopted the principle of 'who reports,who is held liable for evidential burden.' The author of this paper argues that this runs counter to the basic principle of evidential burden provided by the Law of Civil Procedure to the detriment of supervision by public opinion. The author thinks it imperative to reiterate the principle of 'who proposes,who is held liable for evidential burden.
