摘 要: 城中村改造中各类财产权应当如何转换,是新型城镇化进程中法律秩序建构必须解决的问题。权利变换是台湾都市更新的主要实施方式,本质在于公私合力,为更新单元内各种财产权提供公开转换标准。都市更新实务中产生的财产权保障、实施者道德风险、政府职能界定、公众受益等争议对权利变换制度提出改革要求。台湾经验对于反思大陆城中村改造方式、财产权转换机制,以及村民意见调和、政府角色等问题具有启示意义。 How to convert all kinds of property rights in the urban village renovation is an issue that should be solved in the legal order construction in the process of urbanization. Rights transformation is the main way to implement urban renewal in Taiwan, whose essence lies in the fact that it provides a set of open convertible standards for updating all kinds of the unit prop- erty rights through joint public-private efforts. Moreover, the controversies resulting from the practice of urban renewal over the protection of property, the implementers' moral risk, the definition of the government functions as well as the public benefits have called for the reform in the rights transformation system. The paper believes that the Taiwan experience has brought us some enlightenment in rethinking the mode of urban village renovation, the property rights transformation system, the harmony of villagers' opinions and the government's role on the mainland.
