摘　　要： 研究目的：证明自己地役权独立存在的必要性，并对其权利构造及具体适用进行研究。研究方法：采用文献调研、比较研究和法律经济分析等方法，对自己地役权的演进、构造、价值及其具体适用中的问题进行研究。研究结果：（1）自己地役权是一种特殊的地役权，能够从事前的角度更有效率地规范因新型居住形态所产生的区分所有权法律关系；（2）自己地役权可以弥补相邻关系与业主公约的局限性，具有不可替代性。研究结论：自己地役权应成为中国《物权法》地役权体系的一部分。 The purpose of this study is to prove the necessity of easement on one’s own realty to be an independent legality, and to define its structure. Methods of literature analysis, comparison analysis and economics of law were employed. The results show that easement on one’s own realtyis a special kind of servitudes. It meets the objective needs of adjusting new legal relationships on new residential patterns. It could make up the limitations of neighboring relationship and owners’ convention that it’s irreplaceable. In conclusion, it is necessary to improve current provisions about easement and establish easement on one’s own realty in China.
