摘　　要： 当前有关国土空间开发保护的法律规范和制度存在碎片化问题,亟需按照统一的逻辑进行归纳、梳理和整合。国土空间开发保护制度体系构建的基本思路是:以生态文明体制机制改革为基本路径指引,以国家层面机构改革为契机,以国土空间开发保护理念为中心整合不同性质的、散见于不同立法中的法律制度,构建统一的和体系化的国土空间开发保护制度。国土空间开发保护制度的主要内容包括以国家公园为主体的自然保护地制度、主体功能区制度和生态红线制度。 At present, the legal norms and systems related to the development and protection of land and space are fragmented. It is urgent to summarize, sort out and integrate them according to unified logic. The basic idea for the system construction of land and space development and protection is to build a unified and systematic system of land and space development and protection by integrating different legal systems scattered in different legislations. The basic opportunity of system construction is the reform of ecological civilization mechanism and the institutional reform at the national level. The main types of land and space development and protection system include the nature reserve system with national parks as the main body, the main functional area system, and the red line system.
