摘　　要： 我国为保护稀土等自然资源而采取的出口限制措施，在WTO体制下面临困境。为满足国家利益的刚性需求，我国应跳出利用WTO例外条款进行抗辩的法律困局，改变制度依赖路径，在履行国际法律义务的同时以国家安全为立法目标，重构出口管制法律体系，包括：制定《出口管制法》，整合出口管制清单、提升其全面性和技术性，加强促进出口管制遵守的制度建设，以及谋求加入多边出口管制机制，以推动区域性出口管制机制的发展。 After the rare earths case, China＇s export control measures for natural resources came to a deadlock under the WTO regime. To satisfy the rigid demand for protecting national interests, this article argues that China should not merely rely on the WTO regime. Instead, China should focus on rebuilding its national export regime based on national security. Specific proposals include enacting Export Regulation Act, integrating and upgrading export control lists, improving com- pliance with the existing export regulation regime and acceding to multilateral export regulation regime as well as promo- ting the development of regional export regulation regime.
