摘　　要： 《土地管理法》自1986年制定以来，历经多次修订，在新时代需要进行总结以启迪后续修法。最近的《土地管理法（修正案草案）》（第二次征求意见稿）既有进步，亦有不足，亟待进一步完善。《土地管理法》修订在思想理念和原则方向上应坚持以人民为中心，让农民分享更多发展成果；发挥市场机制在资源配置中的决定性作用，推动城乡融合发展；正确处理政策与法律关系，助推土地治理体系现代化；坚持体系性思维，增强改革和修法的协同性。《土地管理法》修订应对耕地保护、集体土地征收、宅基地和集体建设用地等领域的制度进一步完善，在立法目标和理念、法律概念术语和语言表达等立法技术上提高科学化水平。 Since the formulation of the Land Management Law of PRC in 1986, it has been revised many times and needs to be summarized in the new era to enlighten the subsequent revi- sion. The recent Land Management Law of PRC （Draft Amendment） （the second draft） has both progress and shortcomings, and needs further improvement. In the direction of thought and prin- ciple, Land Management Law of PRC should adhere to the people as the center, let the farmers share more development results; play the decisive role of the market mechanism in the allocation of resources, promote the integration and development of urban and rural areas; correctly handle the relationship between policy and law, promote the modernization of the system of land man- agement; and adhere to the systematic thinking to enhance the synergy of reform and amendment of the Land Management Law of PRC. The Land Management Law of PRC should be revised to further improve the system of cultivated land protection, collective land expropriation, homestead and collective construction land, and improve the scientific level in legislative targets, legal con- cept terms and language expression.
