摘　　要： 本文在2007年对全国10省30县田野调查获得的数据的基础上,通过对农村土地所有权主体状况的描述,以及对集体土地所有权主体制度在农村社会运行状况的统计数据分析,结合中国相关法律制度与访谈材料,对中国农村土地所有权主体制度进行了研究。研究结果显示:行政权力严重干扰了集体土地所有权主体制度的正常运行;集体经济的发达水平与集体土地所有权主体制度的运行状况存在正相关性;对农村土地进行确权并颁发相应权利证书,对集体土地所有权主体制度的明晰化极为重要;农户对集体土地所有权主体制度未来变革的期盼与中国当前的制度精神不相符,但其中的矛盾并非不可协调。 The implementing status of nowadays rural land collective ownership subject system could be described as follow:the normal running of the system is heavily disturbed by the administrative power; there is positive correlation between the rural land collective ownership subject system and the economy degree of the collective;it's rather important to confirm the rural land right and issue the corresponding certificate for the clarification of rural land collective ownership subject system;the anticipation of the farmers toward the innovation trend of the rural land collective ownership subject system does not conform to the present legal system principle,though the contradiction could be reconciled.These conclusions are drawn from the study of the present corresponding legal system and the field research materials,based on the analysis of the actual situation of rural land collective ownership subject system reflected by the statistics collected in the field research.The conclusions are preconditioned on the description of the current situation of the rural land collective ownership subject system mirrored by the field research carded out in 2007 covering 30 counties of 10 provinces all over China.
