摘 要: 《农村土地承包法》修改后,因土地承包经营权的权利性质理解发生了分歧,致使进城落户农户之承包地处理规则的理解面临诸多困境。从《农村土地承包法》修正的制度背景和法律规则设计方案来看,处理进城落户农户之承包地时产生制度困境的主要根源在于集体土地的公有制职能虚无化、政策精神之法律表达简单化和法律规则之设计思路逻辑混乱。在解读《农村土地承包法修正案》时,明确土地承包经营权是一种纯粹的财产权,农户进城落户后因成员身份丧失而不再具有参与第三轮土地承包的资格,同时通过农村集体经济组织立法和民法典物权编编纂对超越《农村土地承包法》规范领域的成员权和集体土地所有权等制度予以完善,将有助于进城落户农户之承包地处理规则发挥出预期的制度功能。 After the amendment of the Law on Land Contract in Rural Areas, due to the diverged comprehension of the nature of land contractual management right, there are many difficulties in understanding the rules for the disposal of contracted land of farmers settled in cities. From the perspectives of the institutional background and legal rule design of the amendment, the main reason for the system dilemma of this problem is that the public ownership of collective land becomes idle, the legal expression of the policy spirit is oversimplified, and the design of legal rules is logically chaotic. When interpreting the amendment, it should be clarified that the land contractual management right is a pure property right. After the farmers are settled in the city, they will no longer have the qualification to participate in the third round of land contracting due to the loss of membership. At the same time, through the legislation of rural collective economic organizations and the compilation of the property rights book of the Civil Code, the improvement of the membership right and collective land ownership system beyond the normative areas of the Law on Land Contract in Rural Areas will help the settlement rules play the expected institutional function.
