法团主义视域下的中国农村社会管理体制创新

摘  要: 法团主义强调由国家主导下多元利益主体的协商来协调利益冲突,对创新我国农村社会管理体制有独特吸引力。在法团主义视域下,首先,农村多元利益主体应能通过各种民间组织来实现表达和整合利益诉求;其次,要凸现农村正式权威组织在利益协调中的主导作用,应合理限制强势利益群体的力量与权威,使其不损害公益并承担公共责任,同时,还应通过发展公民社会、加大人力、财力的投入来增强农村弱势社会组织的力量,以实现利益主体的竞争性均衡;再次,培育多方参与的公共领域,村民通过基层民主选举活动、协商性会议、大众传媒等公共论坛来参与协商,形成公共意见。通过以上措施,来实现多元利益的均衡和社会公平正义。 Corporatism, highlighting coordinating the interest conflict through the consultation of multi=interest entities under the guidance of the state, is of special value for the public administrative system in China's rural areas. Under the perspective of corporatism, firstly, rural multi-interest entities can realize the expression and integration the interest appeals through non-governmental organizations. Secondly, to play the leading role in coor- dinating the interests, the official rural authorities should reasonably restrict the power and authority of the advan- tageous interest groups so that they do no harm to the public interest and take the public responsibilities in addi- tion to strengthening the force of rural disadvantageous social organizations through developing civil community and enhancing human and financial input for the purpose of maintaining a competitive balance between interest entities. Still, a public field involving multi-party participation should be nurtured so that villagers could take part in consultations and form public views through some public forums such as grass-root democratic elections, con- sultative meeting and mass media. The multi- interest balance and social equity and justice can be realized through the above measures.
