摘　　要： 从伦理和法律层面论证在一定条件下服刑人员可以捐献自己的活体器官以及死刑犯可以捐献自己的尸体或尸体器官。通过分析我国服刑人员器官移植方面相关立法的一些漏洞和问题,探讨如何更好地从法律上保障服刑人员捐献器官的行为处于公正和可监督的状态之下,以实现切实保障服刑人员及其家属权益的目的。 This article demonstrates that Inmates can donate their own organs in vivo and death penalty criminals can donate their own organs or bodies under certain conditions in ethical and legislative dimensions.And then it pointed out the gaps and problems on related legis-lation to assure such devotion under justness and supervision,to truly protect the rights and interests of Inmates and their relatives.
