摘　　要： 我们应当适时运用医学证据完善法律。神经科学的发展对美国少年司法产生了重要影响,特别是联邦最高法院在Roper、Graham和Miller案的判决中认定少年的大脑发育不成熟,刑事可责性有所欠缺,应减轻刑罚。神经科学证据可以成为我国刑事责任年龄立法的科学根据,也可以应用于未成年人刑事责任能力的个别化判定之中,有利于实现罪责刑相适应原则与社会防卫的目的。 We should timely use medical evidence to improve legislation. The development of neuroscience had a major impact on juvenile justice in the United States, particularly in the Roper, Graham and Miller decisions of the Supreme Court, which found that juveniles are immature and should have diminished responsibility. The neuro- science evidence can be the scientific basis o/the age for criminal responsibility in China, and also can be applied to individualized judgment for social defense and the principle of suiting responsibility and punishment to crime.
