摘　　要： EMR与EHR并非同一概念。当前国内外电子病历应用中的核心问题是个人医疗信息的保护。应用电子病历的正当化根据是个人的欲求与重大公共利益的需要。在法律框架方面,我国需要进行专门的立法以保护个人医疗信息。 EMR and EHR are not identical.The core problem in application of EMR is the protection of individuals＇ medical information in China and abroad nowadays.Individuals＇ desires and the needs of the major public interests are justified grounds of applying EMR.In the aspect of legal framework,China needs special legislation to protect individuals＇ medical information.
