摘 要: 2015年4月,国务院同意新设广东、天津、福建三个自贸试验区,各地自贸试验区改革进入共同发展的阶段。上海自贸试验区开辟了一条从《总体方案》到《管理办法》,再到《条例》立法路径,形成了自贸试验区法制建设的基本框架,其他三地正在复制这些制度成果,但创新能力尚未彰显。与国际化的市场规则相比,四地均须解决管理体系复杂、市场化改革动力不足、新设自贸试验区管理机构与原有片区事权交叉不清的问题。当前阶段,汕头华侨试验区的立法建设应着力复制四地制度成果,总结地方成熟立法实践,并构建权责一致的法治政府。 In April, 2015 the state council authorized to establish PFTZ in Guangdong, Tianjin, Fujian and PFTZ entered the stage of common development. Shanghai PFTZ legislation including the Framework Plan, the Administration Measures, and the Regulations has become the basic legal framework of the PFTA, which Guangdong, Tianjin, Fujian are reduplicating, but their innovative ability of legislation has not been demonstrated.Compared with the international market rules, the PFTA need to solve problems like the complex management system, the lack of motivation in market reform, and entangled responsibilities between the new administrative agencies of PFTZ and district administrations. Currently, the legislation of Shantou Overseas Pilot Zone should adopt the PFTA's legislative achievement, summarize the local mature legislative experience, and construct a local government by law with a parity of authority and responsibility.
