摘　　要： 由于尸体器官的来源不足，导致器官需求和供应的矛盾加剧，许多患者在等待移植的过程中死亡。因此，活体器官移植大量产生。结合国内外的立法状况，在明确我国活体器官移植立法缺陷的基础上，提出了完善活体器官移植立法的意见，包括建立活体器官捐献的激励机制、扩大活体器官捐献者的范围。 The shortage of cadaveric organ source leading to the contradiction between organ demand and supply increased, a large number of patients died during waiting for organ transplants. Therefore, a large number of living organ transplant started up. The author combining the domestic and foreign related legislation condition, clearing about the flaw of legislation on living organ transplanting in our country, give the legislation related comment on living specimen organ transplanting, including establishment of living organ donation incentive mechanism, expansion of living donor organ donors range.
