摘　　要： 个人财产神圣不可侵犯是资本主义法律的核心原则之一,也构成了资本主义法制体系的基石。随着西方政治、经济、文化的发展,其个人财产权观念也经历一个不断变化的过程。这里阐释了近代前后西方个人财产观念,分析了近代个人财产的地位:正当化和神圣化。旨在借鉴西方私产观念理论,为我国的民主法治建设提供一定的政策性思考。 The concept that the individual property is inviolable is one of the core principles of capitalist law and the foundation of the capitalist legal system. With the development of politics, economy and culture in the West, the concept of individual property rights has also undergone a changing process. Through expounding the concept of individual property in the West before and after modem times and analyzing the status of individual property in modem times-justification and sanctification, this paper is aimed to bring forward policy suggestions on the construction of the democracy and the Rule of Law in our country based on the theory of the concept of individual property in the West.
