摘　　要： 技术调查官制度的实施是知识产权专门法院所进行的一项重要司法审判改革,也是最高人民法院在《关于在北京、上海、广州设立知识产权法院的决定》实施满三年后向全国人民代表大会常务委员会报告决定实施情况的重要组成部分。论文以技术调查官制度为考察对象,详细比较中国和日本技术调查官制度的基本内容及实施情况,分析我国技术调查官制度实施中存在的问题并提出相应的完善建议,认为应由最高人民法院统一制定关于技术调查官的工作规范和管理选拔办法,避免技术调查官制度在不同知识产权法院实施中出现差异,从而影响技术调查官作为司法辅助人员的中立性和权威性。 Technical investigator system is an important judicial reform measure accompanied by the establishment of intellectual property courts. It is also among the major events reported by the Supreme People＇s court to Standing Committee of the National People＇s Congress. The paper studies and compares the basic content and implementation of technical investigator system in China and Japan, finds the problems existing in the practices of technical investigator system in China, and proposes some suggestions to the perfection of technical investigator system. It is apparent that the regulation of technical investigator should be made firmly by the Supreme People＇s court, to prevent the differentia of implementation of technical investigator system among different intellectual property courts, and the damage of neutrality and authority of technical investigator as the judicial auxiliary staffs.
