摘 要: 预告登记中,自能够进行不动产登记之日起三个月的起算,应从办理本登记客观条件是否已经具备和预告登记权利人对怠于办理本登记是否存有过错等方面综合判断。登记机构无权自行判定当事人之间的债权是否消灭,无权自行判断自能够进行不动产登记之日起三个月的起算条件,当事人一旦办理了预告登记的,预告登记将一直处于有效状态,当事人要单方申请注销预告登记的,须提供生效司法文书或仲裁裁决文书证明债权消灭,或是预告登记权利人放弃权利单方申请注销预告登记,除此之外,仍需当事人双方申请注销预告登记。 Notice of registration,registration of real estate from the date of starting from threemonths for the registration of the objective conditions have been met and whether notice of theregistration rights on the handling of the registration is being delayed in comprehensive aspectscan judge the fault.The registration agency shall not have the right to decide whether to eliminatecreditor's rights between the parties,shall not have the right to judge the self can don't movefrom the starting three months of the date of registration of the property,the parties for theregistration notice once the registration will be in the active state,the parties shall apply forcancellation of registration unilaterally,to provide effective judicial documents or arbitrationdocuments or the registration of debt elimination,the rights of people to give up the right tounilaterally apply for cancellation notice of registration,in addition,the parties still need toapply for cancellation of registration.
