摘　　要： 长期以来,我国践行的宅基地无偿使用制度缺乏合理的退出机制,"物尽其用"的原则亦未得以体现。在当前城镇化的背景下,从明晰概念出发,有必要对宅基地使用权退出的概念进行界定,厘清宅基地使用权退出及与宅基地使用权消灭、宅基地使用权征收、宅基地使用权流转的关系;明确宅基地使用权退出的主体是宅基地使用权人,客体是宅基地使用权作为特殊用益物权承载的各项权利,结果是宅基地使用权退回给集体经济组织。针对宅基地使用权退出改革实践中存在的问题,未来应进一步完善宅基地用益物权权能及宅基地所有权权能,整合政府、集体、农民三方面的力量建立宅基地回收补偿基金,并健全相关配套制度的建设。 The use of homestead land has been free for a long time.Without a reasonable exitmechanism,the“best use”principle has not been reflected.In the current context of urbanization,defining the concept of exiting homestead land use right,clarify the relationship between theexiting homestead land use right and the homestead land use right extinguishing,expropriationand circulation;clear the subject of the exiting is the famers,the object of the exiting is theland use right,the result of exiting is backing the homestead use right to the collective economicorganization,as that the collective economic organizations is the owner of the homestead.Through thereview of legal issues in the homestead exit,I would like to give the following proposals about theestablishment of homestead use right exit mechanism:richen the homestead use rights and ownershiprights;establish a compensation fund by the farmer,the collective economic organization,and thegovernment;improve the supporting system.
