摘　　要： 绿色技术对于应对气候变化至关重要。我国《专利法》按照发明和实用新型保护绿色技术。通过实用新型保护绿色技术,其实质条件和审批程序均能适合绿色技术法律保护的需要。我国现行《专利法》对实用新型的规定不完全合理。在未来的实用新型单行立法理论预设基础上,可以对绿色实用新型的法律制度进行设计,以满足绿色技术发展和传播的需要。 Green technology is crucial to deal with climate change. The Chinese patent law protects green technology according to invention and utility model. According to utility model protecting green technology,its material conditions and approval procedures can fit the needs of green technology legal protection. Our existing patent law is not entirely reasonable in utility model legal provisions. Basing on theoretical anticipation of future utility model special legislation,we can design legal system of green utility model to fit the needs of green technology developing and spreading.
