摘　　要： 刑法的修正需要考虑变动的社会经济条件,而在变动的社会经济条件之中,国际关系的变化当然也需要考虑。刑法的修正需要国际法视野,国际法视角之于刑法修正的重要性,在于其既会影响我国外交战略转型所需的国内法制的配合,又会影响我国的国家利益和国民利益的有效保护,还会影响我国在参与国际法治建设方面的正面形象。我国当前刑法,无论从所确立的管辖权体系而言,还是从刑法目的和犯罪定义的角度而言,抑或是从分则具体罪名的角度来看,国际法视野都不同程度地缺失,因此需要适当修正。 When amending the Criminal Law, we should consider constantly evolving social and economic conditions. Among them, the change of international relations is one element that needs to be considered. Moreover, amending the Criminal Law from the angle of international law is not only necessary but also important. This is because it will have an impact on China＇ s effective cooperation among its various domestic rules and laws for the strategic transformation of its foreign affairs, which will have an impact on China＇ s effective protec- tion for its state interests and the interests of nationals. Furthermore, it will have a positive impact on China＇ s involvement in constructing rule of law in the international arena. Currently, it is necessary to make an appro- priate amendment for the Criminal Law in China which, to some degree, is absent from the perspective of international law. Such an amendment should ine.lude the established jurisdiction system, the purpose of the Criminal Law, the definition of crimes and some criminal offences which are covered in the specific provisions.
