摘　　要： 文章从外观设计侵权判断规则出发,分析目前判断规则存在的问题,结合司法审判案例,论述"区别于现有设计的设计特征"判断规则,展示其在外观设计相似判断的重要作用,并论述了"区别于现有设计的设计特征"判断规则的制约因素,并提出完善措施。 The article begins with the rules of infringement judgment of industrial design,analyzes the existing problems of the current judgment rules,and combined with judicial case,discusses the judgment rules of the design features different from the existing design,and shows the important role of the design similarity judgment.The article also discusses the constraining factors of the judgment rules of the design features different from the existing design,and propose the measures to improve.
