摘　　要： 在商事思维模式中,破产财产变现本来应该更加注重效率和收益,同时应强调并尊重债权人的意思自治。在我国破产财产司法拍卖实践中,多次流拍现象突出,确定的保留价往往过高,合谋竞价行为时有发生。目前适用范围最广的英格兰式拍卖与荷兰式拍卖均有各自的优缺点,但我国目前在司法拍卖实践中多采用英格兰式拍卖,因此,有必要以商事思维来重新思考现有破产财产变现制度并寻求变革路径。 According to the commercial thinking mode,much attention shall be paid to the efficiency and profits of liquidation of bankruptcy estates,while emphasizing and respecting the autonomy of creditors. There are many problems in China ＇s judicial auction practices of bankruptcy estates,such as abortive auctions,reserved high prices and conspired bidding. The widely-used English auction mode and Dutch auction mode have their own advantages and disadvantages. The English auction mode is widely used in China＇s judicial auction practices,therefore,it is necessary to rethink the current system from the perspective of commercial thinking mode and try to find some possible solutions.
