摘　　要： 案外人异议之诉在执行过程中有效地保障了案外人的权益,然而,要想更有效地发挥案外人异议之诉的作用,就必须解决好案外人先后提起的确权诉讼和异议之诉的关系问题。较为可行的方案是,在理论上建构案外人异议之诉的诉讼标的理论,在实践中针对具体问题进行具体分析,全面解决两诉的重复起诉问题。 The lawsuit filed by an outsider can effectively guarantee the rights enjoyed by the third party not involved in the case. However,if we want to fully exert the function of the lawsuit filed by an outsider,we need to decide the precedence order of the lawsuit filed by an outsider and the claim-confirming proceeding. To be specific,in theory,we shall clarify the objection of action; while in practice,we need to analyze the cases individually,and solve the problem of repeated prosecution.
