摘　　要： 长期以来,我国刑事诉讼活动重点都放在被追诉人身上,使得被害人往往在程序上被忽视。法院刑事案件判决对于被害人财产权保障而言,存在执行难、救济难等一系列问题,容易导致社会正常秩序混乱。基于此,文章提出构建国家补偿机制以及被害人财产挽回机制等措施,以便于被害人在刑事案件中的财产权益能够得到充分的保障。 For a long time,China＇s criminal activities focus on the accused person rather than the victim who is often ignored in the program.As far as protecting the victim＇s property right concerns,there are a series of problems such as law enforcement difficulty and relief difficulty in criminal case judgments.This may disturb social order.It is proposed to develop the national compensation system and retrieving system for the victim＇s property to protect the victim＇s property right fully in criminal cases.
