摘　　要： 伴随着我国《专利法》第四次修订工作的进行,其最新送审稿已明确将惩罚性赔偿作为赔偿方式之一。就目前专利维权情况来看,远难以达到权利人预期效果,惩罚性赔偿之引入或有助于解决当前的困境。文章将结合惩罚性赔偿自身特性与目前专利侵权之现状,对二者的兼容性提出一些看法,进而论证引入惩罚性赔偿的应然性。 Along with the fourth revision of the patent law,punitive damages are clearly defined as one of the compensation ways in the latest manuscript which is sent for reviewing.As far as current situation of patent rights,it is hard to meet the subject＇s expectation.The introduction of punitive damages may be helpful to solve the problem.By comparing the characters and current situation of patent infringement,the issue of their compatibility is discussed to argue the inevitability of applying punitive damages.
