摘 要: 当代中国法学教育面临困境,这与人们对"法是什么"的追问与回答密切相关,对"法是什么"的认知会影响和构造法学教育的模式。将法作为阶级斗争的工具去看待,造就了"政治模式"的法学教育;将法归结为规则的认知,导致了"规则模式"的法学教育;而将法看做实践智慧,将会引发法学教育模式的根本变革。走向实践智慧,乃是中国法学教育改革的基本原则。依据法作为实践智慧的基本判定,则法学教育的改革可以表现为三个方面的基本进路:法学教育的人文取向;法学教育的经验维度;法学教育的道德之维。 Legal education in contemporary China is facing a dilemma, which is closely related to the question of "what is law". The answer to this question will reshape the model of legal education. Viewing law as a tool of class struggle, we build a " political model" in legal education; summarizing law as cognition of rules, we establish a "rule model" in legal education; and considering law as practical wisdom, we will see fundamental reforms in legal education. The practical wisdom should become the basic principle in China~ legal education reform. Based on this principle, education reform can take place in three dimensions: the human perspective, experience dimension and the morality dimension. legal the experience dimension and the morality dimension.
