摘　　要： 清代社会某些特殊主体不能独立参与诉讼,需要抱告代替告状人递交诉状以及承担其他相关的责任。清代各朝状式条例对需要抱告的特殊主体进行了界定,但在诉讼实践中,抱告的类型和实际状态却呈现出更加复杂多样的面相。根据清代巴县诉讼档案,对抱告的实际呈现状态、"老幼"的具体表现、抱告与诉讼当事人的关系、抱告窃名告状等进行归纳和总结分析,以期对清代抱告之规定与实践有更加深刻的认识。 In Qing Dynasty, some special subjects could not participate in the lawsuit independently, so they need Pao-kao to submit the complaint and bear related responsibilities. The regulation of the complaint in Qing Dynasty defines the special subjects that need Pao- kao,but in the practice of litigation, the types and actual conditions of Pao-kao turns out to be more complex. On the basis of the Archives of Baxian in Qing Dynasty, this article summarizes and analyzes the actual state of Pao- kao, the specific performance of the ＂old and young＂, the relationship between Pao-kao and the litigant as well as the cases that Pao-kao complains using the litigant, name in the hope of having more profound understanding of the regulation and practice.
