论检察机关提起公益诉讼的可诉范围

摘  要: 公益诉讼的立法与实践在国外已成熟,我国公益诉讼的立法始于2012年《民事诉讼法》的修订,检察机关提起公益诉讼的实践始于2015年的《改革试点方案》。公益诉讼制度的本质特征有三:保护对象的公益性、利害关系的不特定性、受益人的非特定性和胜诉利益的不可分性。关于检察机关提起公益诉讼,学界存在肯定或否定的观点分歧,从法律规定和司法实践看,检察机关提起公益诉讼已无须争论,但《改革试点方案》确定的检察机关提起公益诉讼的范围过宽且不合理。其可诉范围应当限制,即只能针对损害社会利益而诉讼主体不确定或缺失的违法行为。结合我国国情,目前应限定为侵犯不特定相对人利益的行政不作为类案件。 The legislation and practice of public interest litigation have been matured in foreign countries. The legislation of public interest litigation is started from Civil Procedural Law in 2012. The practice of public interest litigation by Procurator Organs is started from Pilot Program of Reform in our country in 2015. The system of public interest litigation has three characteristics,which are the public welfare of protection objects,the non-specialty of interested relationship,the non-specialty of beneficiary and the indivisibility of the lawsuit interests. There exists argument the affirmative or negative view on public interest litigation by Procurator Organs in our country. There no debates of public interest litigation by Procurator Organs in the legislation and practice,but the range of public interest litigation is too large and is not reasonable in Pilot Program of Reform by the supreme people's procurator in 2015. We must limit the actionable range of public interest litigation by Procurator Organs. And combining with our national condition,the actionable range of public interest litigation should be limited in the kind of administrative omission cases at present,which infringe the non-specialty interest.
