摘　　要： 随着专利权质押融资方式的出现,不仅提高了专利权的转化利用率,使其"物尽其用",而且解决了企业的资金紧缺的难题,使其"扶摇直上"。本文剖析了专利权质押的运行现状,分析了在法律制度、设立规则、实现方式、评估机制、交易市场等方面的不完备之处,有针对性地提供完善策略,以期降低专利权质押的市场风险和法律风险,使企业在提升自身实力的同时为知识产权强国建设添砖加瓦。 With the advert of patent pledge,it not only improves the transformational utilization of patent right that makes best use of everything,but also solves the problem about lacking funds of enterprises,which can help enterprises rise directly to a high position quickly. This paper explains the operational situation of patent pledge and analyzes the incomplete parts in the aspects of the legal system,the establishment of rules,the way of implementation,the assessment mechanism and so on,which well-directly provides a sound strategy in order to reduce the market risk and legal risk of the patent pledge and to contribute to constructing the powerful nation led by intellectual property as well as enhancing the enterprises＇ own strength.
