摘　　要： TPP知识产权规则显失平衡并缺乏可持续性,不能有效减少知识产权贸易和投资壁垒,在世界范围内难以得到推广,无法作为未来国际知识产权谈判的范本。TPP知识产权规则与我国国内发展需求不符,与我国的经济全球化进程再平衡理念相悖,实践也已证明TPP式知识产权规则在国际上行不通。我国并没有支持TPP知识产权规则的合理理由。我国国内知识产权制度发展应当走适度保护和可持续发展之路。知识产权保护须厘清与市场之间的关系,其保护强度须保持在激励创新的必要限度内,知识产权制度设计须为社会公众保留足够的创新空间和竞争空间。同时,我国需要进行知识产权制度创新。在国际上,我国应当以RCEP和"一带一路"为契机和平台,主动掌握知识产权国际话语权,完成从国际知识产权规则"接受者"向"制定者"的转变。积极推动RCEP和"一带一路"知识产权规则走开放、共赢和可持续发展之路,为未来国际知识产权制度的合理发展指明路径。 The TPP IP rules are characterized as being unbalanced and unsustainable. The IP provisions in TPP cannot reduce barriers to trade and investment. The TPP IP chapter can hardly be successfully marketed in the world and cannot be a model for future international IP negotiations. Not only can the TPP IP rules not meet China＇ s domestic development needs, they are also inconsistent with China＇ s idea of rebalancing the economic globalization. The TPP IP rules have already proved themselves to be unworkable in the world. There exist no reasonable grounds for China to adopt the IP rules in TPP. Domestically, China should build up an IP system that provides moderate and sustainable IP protection. The relationship between IP protection and market should be clarified. The extent and scope of IP protection should be kept to an extent that is necessary to provide an incentive to innovate. Enough space should be maintained for future innovation and market competition. Addi- tionally, China should reform the traditional IP system. At the international level, China should use RCEP and the Belt and Road Initiative as an opportunity and platform to have more say in the global IP world and trans- form itself from a ＂taker＂ into a ＂maker＂ of international IP rules. China should actively push RCEP and the Belt and Road Initiative to adopt open, win -win, and sustainable IP rules.
