摘　　要： 法院裁判"假离婚"案件的司法智慧是贯彻"区分原则":区分意思表示动机和内容,以确认当事人终止婚姻关系意思的法律效力;区分身份关系与财产关系,以界分该意思表示之于身份关系和财产关系变动的不同法律效力;区分公法关系和私法关系,以规制"假离婚"引发的次生问题。相较于将"假离婚"阐释为"通谋虚假离婚",司法实践秉持的"区分原则"契合了离婚的法律构造、离婚的运行机理以及公法和私法区分的法律逻辑,应该成为解决"假离婚"引发的利益纠葛和法律评价冲突的当然选择。 The judicial wisdom of the judgments on'fake divorce'is to carry out the principle of distinction:to distinguish the motive and content of expressed intentions so as to confirm the legal effect of the intention to terminate marriage;to distinguish identity and property relationship so as to clarify the different legal effects lead by the intention to terminate marriage;to distinguish the effects of public law and of private law so as to solve the secondary problems caused by'fake divorce'.Compared with the idea of defining'fake divorce'as'collusion of false divorces'brought up by some scholars,the principle of distinction insisted by judicial practice fits more on the legal structure of divorce,the operation mechanism of divorce and the legal logic of distinguishing public law and private law.Therefore,it is definitely the best way tosolve the disputes of interests and conflicts in legal evaluation caused by'fake divorce'.
