摘　　要： 地方政府对其债权的管理既缺乏专业经验,也缺乏专业人才。所以对地方政府的债权管理引入民营化方式是一个合理的选择。这一措施需要接受来自不同层面和部门的法律的审查。除了一般性的关于民营化问题合法性考量之外,人们还需要在预算法、数据安全法等部门立法中对债权管理民营化的合法性问题进行审查。对于这些问题司法实践中也形成了大量值得关注的法教义学上的经验。 The local government lacks both professional experience and professional talents by the management of its creditor＇s rights. Therefore it is a reasonable choice to intro- duce the privatization mode into the creditor＇s rights management for the local government. This measure needs to be reviewed by laws from different levels and departments. In addition to the general consideration of the legality of privatization, people need to review the legality of the privatization of creditor＇s rights management in the legislation of budget law and data security law. For these problems there was a great deal of experience with the legal doctrine that deserves people＇s attention.
