摘　　要： 行政法学领域对比例原则的研究有着突出的特点,主要聚焦于比例原则的源起、内涵、适用范围、比例原则与合理性原则的关系等问题。我国立法及有关文件中对包涵合理性原则与比例原则因素的同时规定,反映出学界对两大原则的共同认可。展望比例原则在我国行政法中的发展愿景,应确立比例原则为行政法的基本原则,逐步替代合理性原则,从目的正当、手段与目的适当、必要性、相称性四个方面构筑比例原则的内容体系,将比例原则的适用范围拓宽到授益性行政行为、行政立法、行政救济等领域。 The study of the principle of proportionality focus on origin, connotation, ap- plicable scope, relationships between the principle of proportionality and the principle of ra- tionality. There are also both factors of the principle of proportionality and the principle of ra- tionality in legislations and documents, and this reflected common recognition. Looking for- ward to the vision of the principle of proportionality, we should establish the principle of pro- portionality for the basic principles of administrative law, and gradually replace the principle of rationality. The content system includes the following aspects, right purpose, appropriate means and purpose, necessity, proportionality. The scope of the principle of proportionality should be extended to the benefits of administrative behavior, administrative legislation, ad- ministrative relief and other fields.
