摘 要: 由于缺乏法治意识、"经济人"诱因、公共部门职能设置不合理、责任追究机制不完善等原因,使得我国公务员中还存在不少失职渎职行为、越权行为、滥用自由裁量权、行政侵权等一系列违法行政行为。而这些违法行政行为的出现,严重影响了我国的政府形象和公共事业,因而,认真分析这些原因并积极探索相应的防范措施,这是全面推进我国依法治国的重要内容之一。 Illegal administrations such as dereliction of duty, ultra vires, abuse of discretionary power and ad- ministrative infringement are very common in Chinese civil servants due to the lack of awareness of lawn"economic man" incentives,unreasonable public sector functions,imperfect accountability mechanisms. The emergence of these illegal administrative acts has serious impact on the image of the government and public utilities. Therefore, a careful analysis of these reasons to actively explore the corresponding preventive measures is one of the important contents of pushing forward the policy of ruling the country by law.
