摘　　要： 公益贯彻慈善法的全部,统摄整个慈善立法,体现慈善法的核心价值。文章从中西两方的慈善事业发展历程出发,理清慈善活动中公益与私益的关系。文章根据新出台的《慈善法》,从公益标准和公益体现两方面阐述慈善法的公益属性。其公益标准主要表现在慈善活动范围,慈善组织,慈善受益对象三个方面;而从慈善活动过程的各个环节,即在慈善物资的"进出"过程中体现公益属性。 Carrying out the public interest charity law and unifying the charity legislation embody the core values of charity law.The paper starts from the development of philanthropy between China and the West,and clarifies the relationship between public welfare and private interests in charity activities.According to the new ＂charity law＂,the article expounds the public welfare attribute of charity law from the aspects of public standard and public welfare.The standard of public welfare is mainly manifested in the scope of charitable activities,charitable organizations and charitable objects three aspects.All aspects of the charity process reflects the public welfare attributes.
