摘　　要： "作诗免罪"是"赋诗"行为的交流与娱乐功能的世俗性延伸,具有更现实而实用的存在价值。唐宋时代"作诗免罪"渐趋成为"科举取士"政治功能的社会化扩张,诱导并掌控了读书人的行为选择与价值取向。明清时期,"作诗免罪"母题秉承前代并被反复言说,是文人理想生存环境的文本化表现。文人以"操纵文字之术"交换"个体自由",是文人群体的"特权",民间化的"有益交换"。文人针对女性与弱者的"代作诗免罪"行为,是其行侠仗义的另类表现。"作诗免罪"的利他取向,使政治权力分享"神圣生命"个体的自私基因得以遗传复制与集体认同。凭借自身不凡的"操纵文字之术"获得狂欢化艺术效果,是政治认同与社会认同的文本化表现。母题在固化"人治社会伦理",有效地阻碍了社会的创造性进化,实现了社会政治行为的反社会公平价值。 ＂ Poem exemption＂ is a secular extension of the exchange and entertainment function of ＂poem＂, which has more realistic and practical existence value. In the Tang and Song dynasties,＂ poem exemption＂ became the so- cial expansion of the political function of ＂ the imperial examinations＂, inducing and controlling the behavior choice and value orientation of the literati. During the Ming and Qing dynasties, the motif of ＂poem exemption＂ adhered to the pre -dynasty and was repeatedly mentioned ,which was the textual expression of the ideal living environment of the literati. The literati exchanged ＂individual freedom＂ with ＂the art of manipulating text＂, which is the ＂ privi- lege＂ of the literati group and a civilized ＂beneficial exchange. ＂ Literati＇ s ＂poem exemption＂ behavior on behalf of women and the weak is their alternative performance of chivalry. The altruistic orientation of ＂poem exemption＂ allows the individual＇ s selfish gene of ＂divine life＂ shared by the political power to be genetically copied and col- lectively recognized. To achieve carnival art effect with their extraordinary ＂art of manipulating text＂ is the textual performance of the political identity and social identity. The motif solidified ＂man -made social ethics＂, effectively hindered the creative evolution of society, and realized the anti - social fair value of the social and political behav- ior.
