摘　　要： 随着网络媒体的迅速发展,社会舆论对司法审判的影响越来越大,不少案件由于舆论的发酵而迅速成为热门话题,舆论对司法审判的影响日益显著。司法审判是一个复杂的系统,其间的各个要素相互作用,相互影响,共同推动系统的有效运作。社会舆论是系统的一个重要反馈机制,在其中发挥着催化剂的功效。适当的舆论监督是司法公正的背书,过分的舆论反弹又会影响司法独立。因此,必须把握系统的整体性、有序性,掌握好舆论这个要素的具体运作,充分保障舆论开放,保证信息公开,保证新闻媒体从业者和法官的职业素养,从而有效平衡舆论监督和司法独立。 With the rapid development of online media, public opinions have greater and greater influences on judicial judgment. Due to reactions in public opinions, many cases have become hot issues. This shows that public opinions have increasingly great influences on judicial judgment. Judicial judgment is a complex system, in which various elements interact with and influence each other, promoting the whole system to run effectively. Public opinions form an important feedback mechanism of the system, working as promoters. Appropriate supervision from public opinions reflects judicial justice, while over-reflection from public opinions will influence independent Judaism. Therefore, we must control systematic unity and order, grasp practical operation of public opinions. In addition, we should guarantee open public opinions to realize open information. We should also guarantee journalists＇ and judges＇ professional qualities. Through these approaches, we can realize the balance between supervision from public opinions and judicial independence.
