摘 要: 《侵权责任法》规定了劳务派遣形式下,发生工作人员执行工作任务侵权时,用人单位的补充责任。在海上运输业中,大量存在船员劳务派遣,而船员常因其过错造成船舶碰撞侵权。本文通过分析《侵权责任法》第34条规定对劳务派遣下用人单位责任规定的法理基础及价值、以及该规定对船舶碰撞侵权责任的适用,提出了完善我国用人单位责任对船舶碰撞侵权责任的立法及司法建议。 The law of tort liability stipulates the supplementary liability of the employer in the form of labor dispatch in case of infringement of the staff's duty to perform the work. In the maritime transportation industry,a large number of seafarer labor dispatch,and the crew often because of their fault caused by ship collision infringement. This paper through the analysis of the legal basis and value of 'tort liability law'provisions of article thirty-fourth of the labor dispatch employer liability provisions,and the provisions of the tort liability of ship collision,puts forward some legislative suggestions to improve our method of ship collision tort liability employer liability in China.
