摘　　要： 保障儿童权利是国家尊重和保障人权的重要内容。登记离婚是我国重要的离婚方式之一,在保障离婚自由的同时,还需要保障儿童权利。我国的登记离婚制度存在适用条件过于宽松,离婚协议缺乏有效监督,忽视儿童权利地位等问题。为完善登记离婚制度,需要树立儿童利益最大化的立法理念,提高登记离婚的适用条件,强化婚姻登记机关的服务意识和监督职责,尊重儿童的权利主体地位。 Protecting children ＇ s rights is the important content of the state to respect and guarantee human rights. The registry divorce is one of the important ways of divorce in our country. We need to protect the rights of children while protecting the freedom of divorce. China＇s registry divorce system is too lenient,the divorce agreement lacks effective supervision,the status of children＇s rights is neglected,etc. To improve the system of registry divorce,we need set the legislative idea of maximizing interests of children,improve the applicable conditions of registry divorce,strengthen the service consciousness and supervision responsibilities of the marriage registration authority and respect the child＇s status as rights subject.
