摘　　要： 传统刑法教义学分别从行为无价值和结果无价值的立场出发,分析偶然防卫行为的定罪和处罚问题。从新角度阐释偶然防卫不构成犯罪的原因,即行为人实际造成的危害后果,经过损益相抵几乎没有损害后果,是否应该定罪量刑,有待商榷。如果此时认定故意杀人,就意味着仅仅因为行为人具有故意杀人的意思而被认定为故意杀人罪,显然有违罪刑法定原则和主客观相统一原则,这种谬误是任何学者都坚决反对的。 Traditional Strafrechtsdogmatik analyses the conviction and punishment of accidental defense from the standpoint of Handlungsunwert and Erfolgsunwert. This paper explains why accidental defense doesn＇t constitute a crime from anew perspective analysis of law and believesactor＇s actual damage is littlebased on the principle of Deduction of Collateral Benefits. In this case,if the judge determines that the actor constituted intentional homicide,the only reason is his subjective evil character. Evidently,it is contrary to the principle of legality and the principle of unification of subjective and objective and hard to be accepted byany researcher.
