摘 要: "猎狐2014"和"天网"专项行动的紧张开展之后,我国的跨境反腐败追逃工作都取得了一定的成效。但是办案机关对国外法律认知较少,缺乏对国际条约利用,缺乏与外逃目的国家引渡条约的签署,进而使外逃贪官引渡陷入困境,在劝返方面自首认定标准不明确,造成追逃工作的障碍。针对这些问题,急需提高办案队伍的能力,加强国际刑事司法协助条约的利用,改革引渡制度,增强引渡成功机率,在法律上明确规定劝返的自首认定标准,推动跨境反腐败追逃体制的重构。 After specific project of "Liehu 2014" and "Tianwang", our cross-border anti-corruption pursuit of work has made a great achievement. But with little understanding of foreign legislation, lack of the use of interna- tional treaties, and the signing of extradition treaties, the extradition of corrupt officials gets into trouble. As for voluntary surrender identification, undefined standard hinders the pursuit work.Therefore, it is urgent to improve the ability of legal staff, and strengthen the use of international criminal judicial assistance treaty, reform the extra- dition system and enhance the success probability of extradition, and define the standard to return to surrender vol- untarily to promote the reconstruction of cross-border anti-corruption pursuit system.
