摘 要: 我国的法治评估实践俨然形成了一场"法治评估运动",但是在整体上仍然存在着"单一性局限",具体表现为:指标内容上的表征主义、功能定位上的考核主义、评估方法上的量化主义、程序设置上的事后主义、立场选择上的旁观主义。法治评估的单一性局限既会损害法治评估的价值,也会戕害法治的发展。我国法治建设的发展性特征要求法治评估的多元化,社会的理性化也为法治评估的多元化提供了可能性。法治评估多元化的关键在于超越法治指数和法治绩效评估的法治评估模式,从建构主义法治评估转向现实主义法治评估。现实主义的法治评估是问题导向的、使用导向的和情境回应型的法治评估,既重视评估结果的使用,也重视评估过程的价值。 While it seems that the rule of law assessment practice in China has formed a "rule of law assessment movement", there is a singleness-limitation about the movement on the whole, which includes the representationalism in assessment index, the examination-focus of function orientation, the quantifica- tion-domination of assessment methods, the ex post perspective in procedural settings, and the onlooker- consciousness on standpoint selection. The singleness-limitation of the rule of law assessment movement will not only undermine the value of the rule of law assessment, but also harm the development of the rule of law. The development feature of construction of Chinas rule of law requires diversified development of the rule of law assessment. Meanwhile, the rationalization of society also provides the possibility for the diversi- fied development of the rule of law assessment. The key to the diversified development of the rule of law as- sessment lies in transcending the existing model of rule of law assessment which is dominated by the rule of law index and the performance of the rule of law. That is to say, the rule of law assessment movement should advance from eonstructivism rule of law assessment to realistic rule of law assessment. Realistic ruleoflaw assessment is problemoriented, utilizationoriented and situationally responsive, which emphasizes both the usability of assessment results and the value of assessment process.
