摘　　要： 2015年12月印发的《生态环境损害赔偿制度改革试点方案》拟于5年内在全国范围内初步构建生态环境损害赔偿制度。该方案试点的重要内容之一即为"开展赔偿磋商"。但是,国内外的直接相关理论却基本为零,因此有必要尽快完成该制度的具体实施方案构想。首先,解答生态环境损害赔偿磋商制度的可行性、性质、原则、目标等基础问题作为建构该制度的基石和指南。其次,明确磋商的当事人、内容、协议的效力等,以完成磋商制度的实体构造。再次,明确磋商的启动时机、终止情形及后评估等,以完成赔偿磋商制度的程序设计。最后,提出磋商制度实施的初步框架图。 The plan for the reform of ecological environment damage compensation system issued in December 2015 is intended to establish an initial compensation system for ecological environment damage within 5 years nationwide. One of the important contents of the scheme is to carry out compensation negotia-tions. However？ there is no direct correlation theory at home and abroad, so it is necessary to complete the concrete implementation plan of this system as soon as possible. First of all,problems like the feasibility, nature, principles, objectives and other basic issues of ecological environment damage compensation consul-tation system should be solved to form the cornerstone and guidelines of the system ; Secondly , the parties , contents and the effectiveness of the agreement should be defined so as to complete the entity structure ; Thirdly,make clear the starting time,termination situation and post evaluation of the consultation system, so as to complete the procedural design of the compensation. Finally, a preliminary framework for the im-plementation of the consultation system is proposed.
