摘　　要： 党章作为最根本的党内法规,是制定其他党内法规的基础和依据。从考察中国共产党党章的历史沿革出发,结合党的几代领导集体核心对于党章性质和地位的论述,详细地阐述了党章在党内政治生活中的地位以及党章对于党组织和党员行为所具有的规范作用;基于党的十八届六中全会提出的全面从严治党的要求,详尽分析了党章在保障全面从严治党中的根本法规的地位和作用,党内法规和规范性文件要服从党章的最高效力,并不得与党章相抵触;党章作为具有最高效力的党内法规,在约束党组织、党员行为方面具有最高性、普遍性、权利与义务相统一性、重点与一般相结合等特征,只有真正地以党章为根本遵循,才能确保党组织、党员以及各级领导干部严格遵守党章,按照党章办事,维护党章的根本法规的权威;从执政党对国家和社会生活实行政治领导的方式出发,按照"依法执政""依宪执政"的要求,探寻了解决党章与国家宪法法律不一致的程序性机制:对党章和国家宪法法律作出适应性的修改,使得党内法规既能很好地维护党章的权威,同时又不违背国家宪法法律的规定。在中国共产党处于执政地位的政治体制下,执政党的党章应当处于国家政治生活的最顶端,具有最高的正当性和合法性。 As the most basic internal law and regulation,the Party Constitution is the basis for all other laws and regulations inside the Party. From a review of the evolution of the Constitution of the Chinese Communist Party,combining the statements made by several-generation leading bodies concerning the nature and position of the Party Constitution,this paper makes a detailed elaboration of the role of Party Constitution in the political life within the Party and the normative action of the Party Constitution on the Party＇s organizations and the behavior of the Party members. Based on the requirement of strengthening Party＇s discipline which was put forward at the 6th Plenary Session of the 18th Party Central Committee,this paper makes an analysis of the position and function of Party Constitution in making the policies concerning the strengthening of the Party＇s disciplines,and other policies and regulations within the Party should obey the top effect of the Party Constitution,and they should not be in conflict with the Party Constitution. The Party Constitution,as the supreme law within the Party,has a combination of supremacy,universality,uniformity of right and responsibility,and generality and specialty. Only obeying the Party Constitutioncan ensure that the Party organizations and Party members and leaders at different levels will strictly obey the Party and maintain the authority of the Party Constitution. From the governance of the political and social life of the Party in power,according to ruling the country with the law,this paper aims to explore the procedure mechanism of the differences between the national constitution and the Party Constitution and suggested some adaptable revisions so that the laws and regulations inside the Party will ensure the authority of the Party Constitution and they will not be in conflict with the laws in the national constitution.
