摘　　要： 随着人工智能的飞速发展,机器人"记者"在新闻社中运用渐广,极大地提高了新闻行业的工作效率,也带来了新的挑战:通过特定的软件编写出的新闻是否属于著作权中作品的范畴?其遭受侵权时如何予以保护?对机器人"记者"的创作成果的定性,要结合机器人"记者"的工作模式,以及法律现有规定和应有的前瞻性预测进行综合考量。 Along with the rapid development of artificial intelligence,the robotMjournalistsMare widely used in the news agencies, which have not only greatly improved the efficiency of the news industry but brought new challenges at the same time. Are the news written by a particular software part of the works in copyright？ How can they be protected when they are infringed？ The qualitative analysis of the creation of the robot＂ journalists＂ should give a comprehensive consideration on the working mode of the robot＂joumalists＂ as well as the existing provisions of the law and the proper forward-looking predictions.
