摘　　要： 在立法与司法活动中,语言学不仅需要考察法律语言是否合乎语法规范,更应该探索语言分析方法如何运用于立法与司法过程的可能性。以＂生父、生母对非婚生子女＂的＂抚养义务＂问题为例,1980年制定的《婚姻法》忽视了生母的义务问题;而2001年对于《婚姻法》的修订又在抚养方式上出现了新的疏漏。如何避免顾此失彼,这不仅是一个法律问题,也是一个语言分析技术问题。在立法过程中,如果对于重要的概念都能够加以＂义素分析＂,则可能避免很多疏漏,明显提高立法质量。 ＂Law and legal system is a kind of pure ＇language form＇＂,in the legislative and judicial activities,linguistics not only examine whether legal language is in accord with Chinese standard,but also explore how language analysis method is applied to the possibility of legislation and judicial process.Taking ＂birth father and birth mother＇s raising obligations＂ to ＂their legitimate children＂ as an example,the marriage law enacted in 1980 ignored ＂the obligation of birth mother ＂.But in 2001,new omission appeared on the revision of the marriage law in ＂raising mode＂.How to avoid attending to one thing and losing another is not only a legal problem but also a technology problem of language analysis.In the legislative process,if important concepts can be examined by ＂sememe analysis ＂,it will avoid many defects,and obviously improve the legislative quality.
