摘　　要： 从当前的环境法规及学者的研究可推知．环境权的本位在于人类对环境的支配。这种本位观并未着眼于环境和环境问题的特质．在逻辑上无法自恰；而且由于其背离了环境权的初衷．因而对保护环境也是助益甚少。通过观察这种本位观的不适当性来论证环境权本位的转换．环境权不过是环境利益的复本．法律上对环境利益优势的认同是实现环境权的现实路径。本位的切换将带来视域的转向．以环境利益优势为本位．是更为本源、动态、功能地思考环境权和解决环境问题的路向。这种本位观旨在通过利益指向将环境视为受保护的对象而非支配的对象．如此也更吻合环境权的本质。 From the review and analysis of the research on present environmental law and scholars, we can draw a conclusion that the orientation of environmental right lies in control over environment. This standpoint hasn＇t considered the specific property of environment, so it can＇t accord with the logic thinking. In addition, it does little good to the protection of environment. On that it has deviated from the original intention of environmental right. This paper demonstrates the change of environmental interests on the unsuitability of the present orientation. On the basis of the origin and essence of environmental right, this dissertation point out that environmental right is only the duplicate of environmental interests, so the identification of the superiority of environmental interests is just the way of realization of environmental right. The transformation of orientation inevitably changes the angle of view. Environmental interests choice—orientation observe and describes environmental right originally, acutely and efficiently. Besides, thanks to the hide value of environmental interests, this orientation certainly has a moral exhortation.
