摘　　要： 文献综述及现状梳理表明现有法治思维和法治方式的理论及实践尚未具备国际视野。一方面基于国际法治的特殊性，国内层面的法治思维和法治方式无法在国际层面自动适用；另一方面出于在国际层面运用法治思维和法治方式的现实需要，法治思维和法治方式具有拓展其国际视野的必要性。法治思维和法治方式拓展国际视野的前提是完善反映国际国内法治连结事项的国内法治；方法是针对国际法治的特殊性作出强调主动参与、形式法治及道德责任的调整；目标是在国际社会中标识中国立场。 Literature review indicates that the theory and practice of the current rule of law thinking and way does not have an international vision. However, on one hand, based on the particularity of the international rule of law, the Chinese rule of thinking and way does not automatically apply in- ternationally. On the other hand,this thinking and way needs to expand its international vision according to practical needs of the international rule of law thinking and way. The premise of expanding the international vision of the rule of law thinking and way is to improve the domestic rule of law that re- flects the link matters of international and domestic law. The method is to emphasize active participation, the formal rule of law and moral responsibility adjustment according to the particularity of the international rule of law. The objective is to identify the Chinese position in the international community.
