摘　　要： 医疗无因管理关系与民法中的无因管理关系相比较，具有自身的特殊性。通过比较分析和案例分析，探讨医疗无因管理关系的类型，分析其法律属性与法律效力的特殊性，为实践中准确适用法律提供理论依据。同时建议完善相关法律，以便给医疗无因管理行为更好的引导和保护。 Negotiorum gestio of medical relation has its own particularity compared with negotiorum gestio in civil law. Based on comparative analysis and case studies, this article discuss the types of negotiorum gestio and analyze its specificity in legal attribute and effect, which helps to provide a theoretical basis for the correct application of law in practice. Meanwhile, it is proposed to perfect related laws in order to provide better guidance and protection on negotiorum gestio behavior of medical relation.
